Bionic Reading® Affiliate Program Terms and Conditions.

By registering for the affiliate program and providing your email address, you confirm your acceptance of these terms and conditions, which are legally binding. Your registration and participation in the program constitute agreement to all terms stated herein, without the need for a physical signature.

1. Scope
These terms and conditions govern participation in the affiliate program of Bionic Reading AG (“we,” “us,” “our”).

 

2. Eligibility
To participate in our affiliate program, you must be at least 18 years old and meet the legal requirements for participation. We reserve the right to decline any application to the program without stating a reason.

 

3. Onboarding and Registration
Registration for the affiliate program takes place through PromoteKit, which handles the onboarding and creation of the affiliate account. After successfully reviewing your application, you will receive an email confirmation if you are accepted into the program. Acceptance into the program is not guaranteed.

 

4. Affiliate Link and Tracking
Upon acceptance into the program, you will receive a personalized affiliate link through PromoteKit that refers to our products or services. You agree to use this link only on approved platforms and in compliance with applicable laws. PromoteKit provides the tracking technology to monitor sales generated by you. Any manipulation of the tracking system or use of unauthorized links is strictly prohibited and will result in removal from the program.

 

5. Compensation
For each sale generated through your affiliate link and successfully completed, you will receive a commission of 30% of the net sale value (excluding taxes, shipping, and refunds). Promotion payments are made monthly, on the 30th of the following month, via PayPal. Refunded, canceled, or otherwise invalid sales will be deducted from the commission payment.

 

6. Tax Responsibility
All affiliates are responsible for the proper declaration and taxation of their earnings. Each affiliate is responsible for reporting income from the affiliate program in their respective tax returns.

 

7. Marketing Activities
You may advertise our affiliate link across various marketing channels, provided this is in compliance with legal requirements and the following guidelines:

  • No misleading or false information about our products or services.
  • No advertising in unsolicited emails (spam).
  • No advertising on websites with illegal, violent, or obscene content. We reserve the right to prohibit specific marketing activities.

     

8. Termination of Partnership
You may terminate your participation in the affiliate program at any time via the PromoteKit platform. We also reserve the right to terminate your participation immediately for good cause, particularly in the event of a breach of these terms, suspected fraudulent activity, damage to reputation, or non-compliance with our data protection policies. Upon termination by us, you forfeit any outstanding commission claims for unlawful or manipulated sales.

 

9. Limitation of Liability
We assume no liability for direct or indirect damages arising from participation in the affiliate program, including lost profits, business interruptions, or data loss. Our liability is limited to the amount of commissions earned by you. PromoteKit is responsible for tracking and data storage; we are not liable for technical failures or data errors caused by PromoteKit.

 

10. Changes to Terms and Right to Object
We reserve the right to amend these terms at any time. Changes become effective immediately upon notification via PromoteKit or email. Affiliates have the right to object to changes and may terminate their participation in the program without any compensation claim.

 

11. Confidentiality
All confidential information, including sales figures, access reports, or other data provided by us, may be used exclusively for participation in the affiliate program and may not be disclosed to third parties. The obligation of confidentiality applies even after termination of the agreement.

 

12. Data Protection
The processing of your personal data within the affiliate program is governed by the privacy policy of PromoteKit (https://www.promotekit.com/privacy), which is responsible for data security and protection. PromoteKit ensures compliance with all applicable data protection laws. For data related to our Bionic Reading® products, our End User License Agreement EULA (https://bionic-reading.com/end-user-license-agreement/) and Privacy Policy (https://bionic-reading.com/privacy-policy/) apply.

 

13. Governing Law and Jurisdiction
Swiss law applies. The company’s registered office is in Chur, canton of Graubünden, Switzerland. Entry in the Commercial Register: CHE-369.166.250. Jurisdiction is Chur, canton of Graubünden, Switzerland.
